Lurking in Russia’s Civil Code is a provision – Article 169 – which makes it possible to nationalise private property on arbitrary grounds. This long-dormant Leninist weapon is being reactivated. On 10 July the Moscow Arbitrazh Court released the text of its 29 June ruling which upheld a claim based on Article 169 against the controlling shareholders of the oil sector in Bashkortostan. A similar case is pending against another mid-sized oil company, Russneft.
