China needs to develop a reliable, impartial and transparent legal system to provide institutional underpinning for the economy and a level playing field for investment, as well as to guarantee social and individual rights in the interest of stability. But judicial reform launched around 2000 is going into reverse as the Hu Jintao administration asserts that the first duty of judges is to buttress the power of the Communist Party and to apply “people’s justice”.
